Rules Specific to North Carolina Military Divorce

In general, North Carolina divorce laws apply to military members the same as civilians, but with additional specifications as outlined in federal law. Understanding these differences ensures a smoother process for all parties involved.

Based on the Soldiers and Sailors Civil Relief Act, 50 UCS section 521, and North Carolina law, a military divorce in the state has the following restrictions:

  • Divorce proceedings can be postponed as long as the service member is deployed and up to sixty days afterward
  • The active duty spouse must be served with a summons (or a waiver affidavit in an uncontested divorce) and a copy of the divorce action
  • One spouse must reside or be stationed in North Carolina for at least six months
  • A spouse is only eligible to receive a portion of the military member’s retirement benefits if they were married for over 10 years during active duty
  • Child support and alimony payments cannot exceed 60% of the military member’s total pay and allowances
